Bush Jitsu Gym Membership Agreement & Waiver

This Membership Agreement ("Agreement") is entered into between the undersigned member ("Member") and Bush Jitsu Ltd, a jiu jitsu gym located in Whangarei, New Zealand. This Agreement is effective as of the Signing date.

1. Membership Term:

• This Agreement shall commence on the Effective Date and continues on terms of each memberships details unless terminated by either party in accordance with the terms herein.

2. Membership Fees:

• Member agrees to pay the membership fees as follows;
• Weekly memberships are paid one week in advance. Upon selecting a membership a charge will be applied to your payment card on file immediately and then every following week automatically. Over due unpaid fees will incur a late fee. A 7 day written advice must be given to cancel memberships. 
• All kids and youth memberships have been formulated by taking a school year (40 weeks) and dividing it in to weekly payments across the full year to make it more affordable. So please note that there will be no trainings for kids and youth during the school holidays, however payments will be required weekly throughout the year.
• Concession cards are charged in full to the payment card on file upon activating a concession card membership. Once a concession card is used up a automatic roll over will occur unless specified otherwise in writing.
• We do not do credit checks and therefore our fees are to be paid in advance at all times.
• A debit or credit card is to be on file in the members profile on Gym Desk for payments to be made on due date.
• A late fee of $5 will be charged for overdue invoices.
• Membership fees are non-refundable, and no refunds will be provided for unused portions of a membership.

3. Gym Access and Use:

• Member will be provided with access to the Gym during operating hours.
• Member agrees to adhere to the Gym's rules and policies, which may include but are not limited to rules regarding conduct, dress code, and safety.
• Member shall notify the Gym of any changes to contact information, including address, phone number, and email address.

4. Waiver and Release:

• Member acknowledges that Bush Jitsu Ltd is a physical and contact sport and involves inherent risks of injury.
• Member voluntarily assumes all risks and hazards associated with participation in jiu jitsu classes and activities at the Gym.
• Member agrees to release and hold harmless the Gym, its instructors, employees, and affiliates from any liability for injuries, damages, or losses sustained during jiu jitsu training.
• The following Waiver forms part of this membership agreement.

Bush Jitsu Limited Waiver

Waiver of Liability and Photo Release for Bush Jitsu Ltd Gym use:

I hereby understand and acknowledge that the training, programs and events held by Bush Jitsu Ltd may expose me to many inherent risks, including accidents, injury, illness, or even death. I assume all risk of injuries associated with participation including but not limited to falls, contact with other participants, the effects of the weather, including high heat and or humidity and all other such risks being known and appreciated by me.

I hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in activity. I acknowledge that I am physically fit and mentally capable of performing the physical activity I choose to participate in. It is understood that before participating in any fitness activity, my doctor must first be consulted for personal risks/benefits.

After having read this waiver and knowing these facts, and in consideration of acceptance of my participation and Bush Jitsu Ltd furnishing services to me, I agree, for myself and anyone entitled to act on my behalf, to HOLD HARMLESS, WAIVE AND RELEASE Bush Jitsu Ltd, its officers, agents, employees, organizers, representatives, and successors from any responsibility, liabilities, demands, or claims of any kind arising out of my participation in the Bush Jitsu Ltd training, programs and or events.

I do hereby give Bush Jitsu Ltd, its assigns, licensees, and legal representatives the irrevocable right to use my name, video, picture, portrait, or photograph in all forms and media and in all manners, including composite, for advertising, for publication or any other lawful purposes, and I waive any right to inspect or approve the finished product, including written copy, which may be created in connection therewith.

By my signature, I indicate that I have read and understand this Waiver of Liability and Photo Release. I am aware that this is a waiver and a release of liability and I voluntarily agree to its terms.

5. Termination:

• Either party may terminate this Agreement with written notice of 7 days.
• The Gym may terminate this Agreement immediately and without notice if Member breaches any of the Gym's rules or policies.

6. Personal Belongings:

• The Gym is not responsible for lost or stolen personal belongings. Members are encouraged to secure their belongings in provided storage areas.

7. Confidentiality:

• Member agrees not to disclose any proprietary or confidential information obtained during the membership, including training techniques and Gym operations.

8. Amendments:

• The Gym may amend this Agreement and its rules and policies upon written notice to the Member.

9. Governing Law:

• This Agreement shall be governed by and construed in accordance with the laws of New Zealand.

10. Entire Agreement:

• This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements, representations, and understandings.

11. Acknowledgment:

By signing below, the Member acknowledges that they have read, understood, and agree to abide by the terms and conditions of this Membership Agreement.
